Experienced Georgia Personal Injury Lawyers Who Win Cases

Representing Injured Individuals and Families Throughout Georgia

When life takes an unexpected turn, an accident, an injury, or something that should not have happened, you are left trying to figure out what comes next.

Medical bills. Missed work. Insurance calls.

And one question that matters more than anything: Do I have a case?

What most people don’t realize is this: the first few days after an accident often shape what your case is worth.

At Boggs, Cowan & Fargione, we help real people solve real problems. Whether you’ve been injured in a car accident, hurt on someone else’s property, or dealing with the aftermath of a serious injury, we’re here to guide you every step of the way.

What Is Personal Injury Law in Georgia?

Personal injury law allows you to recover compensation when someone else’s negligence causes you harm. But in Georgia, it’s not enough to simply be injured. You must prove that another party is legally responsible.

What You Must Prove to Win a Personal Injury Case

• Duty of Care: The other party had a legal responsibility to act safely. Example: A driver has a duty to follow traffic laws.
• Breach of Duty: They failed to uphold that responsibility. Example: Running a red light or texting while driving.
• Causation: Their actions directly caused your injuries. This is where many cases fall apart because insurance companies often argue your injuries were pre-existing or unrelated.
• Damages: You suffered measurable losses, such as medical bills, lost income, pain and suffering, or emotional distress.

Example: If a driver runs a red light in Athens, Georgia and hits your vehicle, causing injuries that require surgery and time off work, you may have a valid personal injury claim.

Types of Personal Injury Cases We Handle

Personal injury law covers a wide range of incidents. At BCF, we focus on cases that impact everyday families.

Car Accidents

We represent individuals injured in motor vehicle collisions caused by negligent, distracted, or reckless drivers. Watkinsville and the surrounding Oconee County area are served by several well-traveled routes — including US-441, State Routes 15, 25, and 53 — where accidents occur regularly.

Truck and Commercial Vehicle Accidents

Crashes involving commercial trucks often involve multiple parties and complex liability questions. We handle claims arising from commercial vehicle accidents and work to identify all responsible parties.

Wrongful Death

When negligence results in the death of a loved one, surviving family members may have legal options under Georgia's Wrongful Death Act. We handle these claims with care and work to pursue recovery for the families we represent.

Premises Liability

Property owners owe a duty of care to those on their property. When unsafe conditions cause injury (whether in a store, apartment, or public space) those responsible may be held accountable.

Product Liability

When a defective or dangerous product causes injury, the manufacturer, distributor, or seller may bear responsibility. We represent individuals harmed by products that failed to perform safely.

Medical Malpractice

When a healthcare provider's negligence causes harm, the consequences can be life-altering. These cases often require careful review and expert involvement, and we represent patients and families harmed by substandard care.

Workplace Injuries

Injured workers may have rights under Georgia's workers' compensation system, and in some situations may also have claims against third parties. We assist clients in understanding and pursuing their options.

What Your Personal Injury Case May Be Worth

Every case is different, but understanding the types of compensation available can help set expectations.

Economic Damages

• Medical expenses, past and future
• Lost wages
• Loss of earning capacity
• Rehabilitation costs

Non-Economic Damages

• Pain and suffering
• Emotional distress
• Loss of enjoyment of life

What Impacts Case Value?

• Severity of injuries
• Length of recovery
• Impact on daily life
• Insurance coverage available
• Strength of liability evidence

One of the most common questions we hear is: “What is my case worth?” The honest answer: it depends. But we’ll give you a realistic assessment from day one.

Why Choose Boggs, Cowan & Fargione?

Clients who come to our Watkinsville office are working with attorneys who practice in the local courts, understand the Western Judicial Circuit, and bring real trial experience to every case.

Trial-Ready from the Start. Our attorneys prepare each case as though it will go to trial. That preparation — gathering evidence, identifying liable parties, and building a clear legal theory — positions cases for stronger outcomes, whether through settlement or in the courtroom. Founding attorney Lucas Cowan began his legal career as a prosecutor handling felony cases for the State of Georgia, developing a foundation in courtroom advocacy that informs his civil practice today. Partner Al Fargione has handled high-stakes civil and criminal litigation in State, Superior, and Federal Courts across Georgia, and holds both a J.D. and an LL.M. Both Mr. Fargione and partner Lucas Boggs have been recognized by Super Lawyers as Rising Stars.

Selective Caseload, Personal Attention. We limit the number of cases we take so that every client works directly with an attorney and receives focused, individualized representation.

Statewide Georgia Practice. While we are based in Watkinsville and serve clients throughout Oconee County and the Athens area, our practice extends statewide. We represent clients from Athens to Savannah and across the state.

Honest Assessment. We provide straightforward guidance about your situation, your options, and realistic expectations. We do not make promises about outcomes.

Prepared for Litigation. Some cases resolve through negotiation. When they do not, we have the experience and resources to take a case to trial.

What to Do After an Accident in Georgia

The steps you take immediately after an accident can make or break your case.

  • Seek Medical Attention

  • Call the Police - A police report helps establish fault and document what happened. If police were not called at the scene, speak with an attorney as soon as possible about what documentation may still be available.

  • Document Everything - Photos of the scene; Witness contact information; Damage to vehicles or property;

  • Avoid Talking to Insurance Adjusters Alone - Insurance companies are trained to minimize payouts.

  • Contact a Personal Injury Lawyer - The sooner you involve an attorney, the better your chances of protecting your claim.

Understanding the Georgia Statute of Limitations

In most cases, you have 2 years from the date of injury to file a personal injury claim in Georgia. But this rule has important exceptions.

• Claims Against Government Entities: You may need to file an ante litem notice, which is a pre-lawsuit notification, within 6 months for city claims or 12 months for state claims.
• Cases Involving Minors: The clock may be paused until the child turns 18.
• Discovery Rule: If injuries are not immediately obvious, the timeline may begin when the injury is discovered.

Missing a deadline can permanently bar your claim. This is one of the most important reasons to speak with an attorney early.
